Implied Warranty

When a company advertises a product for sale, the warranty is implied, in other words, they are representing to potential purchasers that the product will perform as it should and that there is nothing of significance wrong with it. this implied warranty is unspoken and unwritten.

Example
If a consumer purchases a new computer from an electronics store they have the right to expect that the computer will work properly for the purchase for which it was purchased. If it does not, the selleris obligated to provide a "remedy" to the customer. According to the Federal Trade Commission, "Section 2-314 of the Uniform Commercial Code, which is law in every state but Louisiana, covers the implied warranty of merchantability."
