Expressed Warranty

An expressed warranty is a voluntary, explicit promise you make to your customers. It typically includes a commitment to remedy any defects or problems they may experience.

Section 2-313 of the Uniform Commercial Code covers expressed warranties.

The Magnuson-Moss Act outlines requirements for warrantors:
 

  1. "As a warrantor, you must designate, or title, your written warranty as either 'full' or 'limited.'"
  2. "As a warrantor, you must state certain specified information about the coverage of your warranty in a single, clear and easy-to-read document."
  3. "As a warrantor or a seller, you must ensure that warranties are available where your warranted consumer products are sold so that consumers can read them before buying."

Example
An electronics manufacturer may provide customers with a product warranty stating a period of time the warranty is valid, that the company will repair or replace the product as a result of problems that occur during the warranty period.
